CO COUNCIL FACING €2.8 MILLION MALICIOUS INJURIES ACTION OVER MUCKNO FIRE

Monaghan Co Council members were told on Tuesday that the authority is facing a legal claim for €2.8 million under the Malicious Injuries Act arising from the fire which damaged the Hope Castle property at Lough Muckno in Castleblayney recently.
Members were briefed on the pending court action, which is being taken against them by a lessee of the ‘Blayney property, by Acting Co Manager David Fallon, who also stated that a Circuit Court case relating to the leasing agreement in respect of the property at Muckno was listed for hearing on January 25. Mr Fallon said that the Council’s legal adviser would give an in-committee briefing to the elected members on all aspects of the Muckno situation at their February meeting.
The Acting Manager informed the meeting that if the action were to be successful, the amount of the claim would be funded by the local authority first and then reimbursed by the State.
