A CO. MONAGHAN law firm, which succeeded in securing a €3.75 million settlement in the High Court in Dublin last week, in a medical negligence claim on behalf of a 17-years-old youth, has made legal history!.
The same firm has scored a “double” in the wake of the success of a somewhat similar action on behalf of a young Co. Monaghan girl in 2005—which then led to a record pay-out of €2.2 million!.
It has emerged the well known Castleblayney law firm of Messrs Coyle, Kennedy and MacCormack, Solicitors, acted for a Mullingar family which captured national headlines over last week’s settlement.
Lawyer Mr. Sean T. Kennedy of the firm whose late father was a District Court judge, and his late aunt, Ireland’s first female District Justice—confirmed they were assigned the action taken by the family of Sean Byrne (17) of Grange Heights, Mullingar, against the Midland Health Board and the Health Service Executive.
The action by Sean Byrne’s mother, Mrs Joan Byrne, which led to the High Court settlement approved last Thursday, arose as a result of brain damage to her child at birth, because of a delay in his delivery at Mullingar General Hospital in 1994.
Yesterday, Mr. Kennedy said: “We were absolutely delighted with the outcome of the action, and also very happy for Sean and his family”.
“Despite having his life impaired by celebral palsy, Sean has now his future well assured”.
“He is a wonderful young man, and despite the daily difficulties which he faces, he very courageously took part in the basketball events in this year’s Special Olympics”.
