WOMAN CAUGHT SPEEDING TWICE ON THE SAME DATE, COURT HEARS

CASE ADJOURNED AS JUDGE SEEKS CLARIFICATION ON WHETHER TWO NOTICES WERE SENT OUT

A WOMAN who told last week’s sitting of Monaghan District Court that she received no notices in the post about two speeding offences she allegedly committed on the same day had her case adjourned until 13th March, so that confirmation could be obtained as to whether the notices would have been posted separately or together.

In instances where respondents have sworn on oath that they did not get the fixed charge in the post — and therefore did not have a chance to pay a lesser fine before being summoned to court — the normal practice of the court has been to allow them the “benefit of the doubt” on the first occasion and strike the summonses out.
